If you practice in mortgage foreclosure defense, you'll certainly understand the above play on words.
On June 30, 2020, Arthur proved once again that justice always prevails. If you ever lost faith in our legal system, Arthur encourages you to read the decision of the Illinois First District Appellate Court in Deutsche Bank v. Cortez which can be viewed on the Illinois Appellate Court's website at: https://courts.illinois.gov/Opinions/AppellateCourt/2020/1stDistrict/1192234.pdf
Arthur believes that this case was one of the most significant victories in his legal career.
Things have changed. The legal profession is no different. Many courts are still closed, or are operating quite differently. Some Courts have started to use Zoom for oral arguments.
On June 11, 2020, Arthur conducted his first Appellate Court argument in the Illinois Appellate Court via Zoom. The case Arthur argued was captioned Deutsche Bank v. Cortez. A link to the Illinois Appellate Court's website with the argument is here:
Almost 2 years after losing in the First District Appellate Court, Arthur C. Czaja was able to secure an important Appellate victory for his clients in Federal National Mortgage Association v. Akogu, 2018 IL App (1st) 17-0621-U. Arthur convinced the First District Appellate Court to reconsider its prior decision and, in so doing, the case was remanded to the trial court for an evidentiary hearing on the issue of post-judgment of foreclosure advances made by a lender. Arthur and his clients are considering an appeal to the Illinois Supreme Court to address a different part of the appeal. Arthur is so grateful to his clients for sticking with him in a very long and hard-fought case. Once again, justice prevailed.
On November 5, 2019, Arthur C. Czaja obtained a reversal of a judgment in favor of the lender in the Illinois First District Appellate Court in the case of Associates Asset Management, LLC v. Cruz, 2019 IL App (1st) 182678. Arthur handled this case since 2013 through the trial and prevailed on the appeal on November 5, 2019. The opinion can be found online on the Illinois Supreme Court's website at https://courts.illinois.gov/Opinions/AppellateCourt/2019/1stDistrict/1182678.pdf
On June 25, 2019, the First District Appellate Court granted the Petition for Rehearing filed by Arthur C. Czaja on behalf of his clients in a mortgage foreclosure case that went through the trial court in Cook County and then to the First District Appellate Court. A Petition for Rehearing asks a reviewing court to reconsider its decision. The case involved a mortgage foreclosure and a loan modification. The precise issue the Appellate Court has been asked to reconsider is the requirements for a lender to prove its post-judgment advances after a judgment of foreclosure is entered. The case is entitled Federal National Mortgage Association v. Akogu, Case Number 1-17-0621 and is currently being briefed in the First District Appellate Court for the State of Illinois.
